Chol HaMoed Succot

In Honor of Succot

This week, due to the chol hamoed reading we will not have a selection from the parsha- which would be v’zot habracha.

But I leave you with the concluding lines of a midrash Tanhuma from within the portion of Pinchas in the book of Bemidbar (Numbers)

The midrash is discussing what does it mean when God asks something of you, as is the nature of commandments. The midrash brings a few examples. The midrash also asks by way of implied argument, can the same demand be made of God? Will God do what he promised? The theme of the midrash is God only asks of us to do what we can. The answer to the question is that God demands of Himself only that which He can do as well. But for the Omnipotent, what is out of bounds?
The connection is the closing prooftext of the midrash, that of the command to take the four species of the festival of Succot.

מדרש תנחומא )ורשא( פרשת פינחס סימן יד
כשבקש מהן לא בקש אלא כפי כחם שנאמר (ויקרא כג:מ)"וּלְקַחְתֶּם לָכֶם בַּיּוֹם הָרִאשׁוֹן פְּרִי עֵץ הָדָר כַּפֹּת תְּמָרִים וַעֲנַף עֵץ עָבֹת וְעַרְבֵי נָחַל וּשְׂמַחְתֶּם לִפְנֵי יְדֹוָד אֱלֹקיכֶם שִׁבְעַת יָמִים"

When God asks of us he only asks that which is within our ability. The prooftext for this is the commandment to take the four species on Succot: Etrog (citron), Lulav (Date brach), hadas (myrtle), and arava (willow). There are a few midrashim that comment that the commandment is specifically one etrog, one lulav, three willow and exactly two aravot. No less and no more. This is what God asks of us.

וכשהוא נותן לפי כחו שנאמר (ישעיהו מא:יט) " אֶתֵּן בַּמִּדְבָּר אֶרֶז שִׁטָּה וַהֲדַס וְעֵץ שָׁמֶן אָשִׂים בָּעֲרָבָה בְּרוֹשׁ תִּדְהָר וּתְאַשּׁוּר יַחְדָּו"וכתיב (ישעיהו נה:יג) "תַּחַת הַנַּעֲצוּץ יַעֲלֶה בְרוֹשׁ <תחת> וְתַחַת הַסִּרְפַּד יַעֲלֶה הֲדַס וְהָיָה לַידֹוָד לְשֵׁם לְאוֹת עוֹלָם לֹא יִכָּרֵת"

And when God gives us, or fulfills his end of the deal, He also gives within his strength. The prophecies of Isaiah denote a time where God will bring trees to grow in the wilderness, and fir trees will grow in place of the nettles.

Ha'Azinu

This week’s midrash selection is a fabulous way to comment on Yom Kippur and on the parsha. While the midrash begins with raising an eyebrow over Moshe’s audacity to call the heaven and earth as witness to Israel’s covenant before he takes leave of them, the end of the midrash picks up after a difficult segue to give us perhaps the earliest or one of the earliest sources for giving tzeakah for the elevation of the souls of our departed relatives on Yom Kippur.
The language is difficult- the midrash seems to imply that it is a given that we can redeem ourselves. The novel idea offered in the reading of the verse offered is that we can effect change for the deceased. We can raise their souls as the hunter shoots his arrow up. [Maybe I will write more on the zodiac at a later time]

מדרש תנחומא (ורשא) פרשת האזינו סימן א

The midrash begins with the opening verse of the parsha. Moshe calls upon the heaven and earth to bear witness for what he is saying. The midrash praises Moshe for being able to be so bold, akin toa king commanding his servants to listen to him.

(דברים לב:א) "הַאֲזִינוּ הַשָּׁמַיִם וַאֲדַבֵּרָה וְתִשְׁמַע הָאָרֶץ אִמְרֵי פִי"
"הַאֲזִינוּ הַשָּׁמַיִם וַאֲדַבֵּרָה"-אשרי ילוד אשה שאומר למלאכת השמים כמלך שאומר לעבדיו 'האזינו ושמעו לדברי', כך הוא אומר לשמים וארץ 'שתקו עד שתכלה כל דברי'.

The midrash begins another comment on the appointing of the heaven and earth as eternal witnesses. But rather than view the assignment as a negative, the verse is quoted from Jeremiah as a prophecy guaranteeing the eternity of the Israelite nation.

"הַאֲזִינוּ הַשָּׁמַיִם"
זה שאמר הכתוב (ירמיהו לא:לו)"כֹּה אָמַר יְדֹוָד אִם יִמַּדּוּ שָׁמַיִם מִלְמַעְלָה וְיֵחָקְרוּ מוֹסְדֵי אֶרֶץ לְמָטָּה גַּם אֲנִי אֶמְאַס בְּכָל זֶרַע יִשְׂרָאֵל עַל כָּל אֲשֶׁר עָשׂוּ נְאֻם יְדֹוָד"
The prophet recalls God’s promise that only if the heavens could be measured or the underground be explored would God be able to consider eradicating Israel. In other words it is an impossibility.
The midrash continues with the equation that since Israel is eternal so must be the witnesses to the agreement etched out by Moshe. But as in the Torah penal system, the witnesses are required to be at the forefront of the punishment. Therefore the heaven and earth will be at the fore of the punishment when Israel neglects to follow the agreement etched out, namely the Torah.

לפי שהם קיימים לעולם וישראל קיימים לעולם, לכך הזמינם לעדות שיקיימו ישראל התורה והמצות. ואם חס ושלום יבטלום יד העדים תהיה בם בראשונה להמיתם.

What would be the punishment meted out by the heaven and earth? The rain would stop as forecast (pun intended) by the second paragraph of the shma.

כתיב (דברים יא:יז) "וְחָרָה אַף יְדֹוָד בָּכֶם וְעָצַר אֶת הַשָּׁמַיִם וְלֹא יִהְיֶה מָטָר וְהָאֲדָמָה לֹא תִתֵּן אֶת יְבוּלָהּ וַאֲבַדְתֶּם מְהֵרָה מֵעַל הָאָרֶץ הַטֹּבָה אֲשֶׁר יְדֹוָד נֹתֵן לָכֶם"
לכך הזמינם לעדות כשיקיימו ישראל התורה והמצות ואם חס ושלום ימאנו יד העדים תהיה בם בראשונה, שנאמר (דברים לא:כח)"הַקְהִילוּ אֵלַי אֶת כָּל זִקְנֵי שִׁבְטֵיכֶם וְשֹׁטְרֵיכֶם וַאֲדַבְּרָה בְאָזְנֵיהֶם אֵת הַדְּבָרִים הָאֵלֶּה וְאָעִידָה בָּם אֶת הַשָּׁמַיִם וְאֶת הָאָרֶץ"
Here, the midrash begins a tangent. It references a p’sikta, which is a very old midrash collection, however, I cannot find it in the pesikta that is extant. The excerpt relates man to the 12 stages of the zodiac- the connection being the heaven and the zodiac. At birth man is pure as represented by the goat (capricorn), which is soft and continues building the analogies to the scales (libra) which is the model for judgment of our deeds, both good and wrong. If one does not repair their deeds they are equated with a scorpion (scorpio). If one repents then he is shot like the arrow of the archer (sagittarius). Then the midrash hits us with a non-sequitur stating that this is the reason we mention the departed on Shabbat, so they do not return to gehinom?!

ולכך העמידם לעדות דאיתא בפסיקתא:
אדם נמשל לשנים עשר מזלות. בתחלה כשנולד נדמה כטלה שהוא רך, ומתגבר כשור כשגדל. ונעשה תאומים, כלומר שלם וגדל בו יצר הרע. ותחלתו חלש כסרטן ואחר כך כשנתגדל נתגבר כאריה, ואם חוטא נעשה כבתולה. ואם מוסיף עונות, שוקלים אותו במאזנים. ואם יעמוד במרדו, מורידין אותו לשאול תחתית, שאול וגיהנם כעקרב המוטל לארץ ולשיחין. ואם ישוב זורקין אותו לחוץ כמורה החץ בקשת. לכך רגילין להזכיר המתים בשבת שלא ישובו לגיהנם.

Here the midrash develops another tangent. Since it has stated that we can have an effect on the deceased, mentioning them on Shabbat (I assume this is referencing the custom of reciting the kel maleh on the Shabbat before a yahrtzeit), the midrash cites another source that establishes the potential for our effect on the souls of the departed. The tzedakah (I do not like to use the improper translation charity) we give on Yom Kippur has an effect on the souls of the departed. There is atonement for the deceased through our actions. This, to my knowledge is the earliest source for giving tzedakah before the yizkor service on Yom Kippur.

שכן איתא בתורת כהנים:
(דברים כא:ח) "כַּפֵּר לְעַמְּךָ יִשְׂרָאֵל אֲשֶׁר פָּדִיתָ יְדֹוָד וְאַל תִּתֵּן דָּם נָקִי בְּקֶרֶב עַמְּךָ יִשְׂרָאֵל וְנִכַּפֵּר לָהֶם הַדָּם"
"כַּפֵּר לְעַמְּךָ יִשְׂרָאֵל" - אלו החיים, "אֲשֶׁר פָּדִיתָ" אלו המתים. מכאן שהחיים פודין את המתים. לכך אנו נוהגין להזכיר את המתים ביום הכפורים ולפסוק עליהם צדקה. שכן שנינו בתורת כהנים 'יכול משמתו לא יועיל להם הצדקה, תלמוד לומר "אֲשֶׁר פָּדִיתָ"'.
The midrash returns to its discussion of the zodiac. By giving tzedakah on behalf of the deceased their souls are raised like the archer’s arrow(sagittarius). Then the soul returns to its pristine state of being like the goat, and the soul is purified as if immersed by the water carrier’s bucket (aquarius) and is free to enjoy the spiritual bounty like a fish (pisces) in the water. Then the soul can partake of the Tree of Life that now sits at the border of the righteous. The soul then partakes of the table of the righteous and lives forever.

מכאן כשפוסקין צדקה בשבילם מוציאין ומעלין אותן כחץ מן הקשת.
מיד נעשה רך ונקי כגדי ומטהרין אותו כשעה שנולד, ומזין עליו מים טהורין מדלי, וגדל ברוב הנאה כדג הנהנה במים. כך הוא טובל בכל שעה בנהרי אפרסמון, ובחלב, ובשמן, בדבש. ואוכל מעץ החיים תמיד הנטוע במחיצת הצדיקים. וגופו נוטה על כל שלחן של צדיק וצדיק וחי לעולם.

I must once again apologize for only posting the first part of the midrash tanhuma this week. With Rosh Hashanah, selichos etc … But it perhaps leads us to an interesting understanding.

What makes the Jews special?
This question has two main answers. Is it nature or nurture? Rabbi Judah Halevi in the middle ages was of the opinion that it was nature. However, the midrash may offer the alternate, namely nurture, when the Torah is our source of nutrition. But it might be a little of each. After all we were chosen to receive the Torah. Melding the two approaches we can find that Jews are special in that they merited receiving the Torah but they only retain that special identity if they follow the Torah.

מדרש תנחומא (ורשא) פרשת וילך סימן ב

(דברים לא:א) "וַיֵּלֶךְ מֹשֶׁה וַיְדַבֵּר אֶת הַדְּבָרִים הָאֵלֶּה אֶל כָּל יִשְׂרָאֵל"
"אֶת הַדְּבָרִים הָאֵלֶּה" זה שאמר הכתוב (משלי כב:כ) "הֲלֹא כָתַבְתִּי לְךָ <שלשום> שָׁלִישִׁים בְּמוֹעֵצֹת וָדָעַת"
"מוֹעֵצֹת" עולה בגימטרי-ה תר"ו(606) ושבע מצות שנצטוו לבני נח תרי"ג (613). וכן הוא אומר (ישעיהו ה:א) "אָשִׁירָה נָּא לִידִידִי שִׁירַת דּוֹדִי לְכַרְמוֹ כֶּרֶם הָיָה לִידִידִי בְּקֶרֶן בֶּן שָׁמֶן"
"כֶּרֶם" זו ישראל, שנאמר (ישעיהו כז:ב) "בַּיּוֹם הַהוּא כֶּרֶם חֶמֶר עַנּוּ לָהּ"

The midrash reacts to the quote from the parsha with a citation from proverbs, mishlei. The verse according to Rashi refers to the entire Tanach, Torah, Neviim, and Ketuvim. The metzudat David comments that the wisdom is referring to the Torah, which is the book of instruction. Either way the implication is that the Torah is a book of wise instruction. The midrash uses gematria to buttress its message that the verse from mishlei is referring to the Torah in its 613 commandments.

(ישעיהו ה:ב) "וַיְעַזְּקֵהוּ וַיְסַקְּלֵהוּ וַיִּטָּעֵהוּ שֹׂרֵק וַיִּבֶן מִגְדָּל בְּתוֹכוֹ וְגַם יֶקֶב חָצֵב בּוֹ וַיְקַו לַעֲשׂוֹת עֲנָבִים וַיַּעַשׂ בְּאֻשִׁים "
"וַיְעַזְּקֵהוּ" באברהם, שהשלכתי הפסולת ממנו כגון ישמעאל. "וַיְסַקְּלֵהו"ּ ביצחק שיצא ממנו עשו. "וַיִּטָּעֵהוּ שֹׂרֵק" הוא יעקב שכל הנטיעות שיצאו ממנו היו טובות ונחמדות כשורק, זה שכולו טוב וזה כלו זרע אמת. שורק עולה בגימטריא תר"ו ושבע מצות של בני נח הרי תרי"ג.
The midrash then introduces another passuk, from Isaiah. This verse, explains Radak, explores a relationship between Israel, the vine, and God. Almost tangentially the midrash inserts another passuk from Isaiah that it explains is referring to the “evolution” of the patriarchs leading to Jacob who had all 12 sons dedicated to the nation and God of Israel. The midrash uses a gematria of the 613 calculation to again shore up its point.
כתיב (משלי ג:יט) " יְדֹוָד בְּחָכְמָה יָסַד אָרֶץ כּוֹנֵן שָׁמַיִם בִּתְבוּנָה" ואין חכמה אלא תורה .
ומה שמה? אמון, שנאמר (משלי ח:ל) " וָאֶהְיֶה אֶצְלוֹ אָמוֹן וָאֶהְיֶה שַׁעֲשֻׁעִים יוֹם יוֹם מְשַׂחֶקֶת לְפָנָיו בְּכָל עֵת". ולא נקראת 'תורה' עד שנתנה בסיני. ועל מנין המצות נקראת תורה, כי המצות של תורה הן תרי"ג. תורה עולה בגימטריא תרי"א (611) והשנים שנפחתו מן תרי"ג (613) אלו שנים שנתנו מפי הגבורה. וזהו שאמר הכתוב (תהלים סב:יב) " אַחַת דִּבֶּר אֱלֹקִים שְׁתַּיִם זוּ שָׁמָעְתִּי כִּי עֹז לֵאלֹקִים"
וזהו (דברים לג:ד) "תּוֹרָה צִוָּה לָנוּ מֹשֶׁה מוֹרָשָׁה קְהִלַּת יַעֲקֹב"
כמנין "תּוֹרָה צִוָּה לָנוּ מֹשֶׁה" והשנים צוה הקדוש ברוך הוא כמו שפרשתי בפרשת 'וישמע יתרו'.
The midrash, using the gematria, transitions to a variation on the question of which statements of the Decalogue were actually heard by the Israelites at Sinai. Despite the variation the conclusion remains that the Israelites heard two commandments (statements) at Sinai directly from the source and the rest were through Moses.

והיא " מוֹרָשָׁה" לבני יעקב ולא לעובדי עובדי גלולים. שנאמר (תהלים קמז:יט-כ) " מַגִּיד <דברו> דְּבָרָיו לְיַעֲקֹב חֻקָּיו וּמִשְׁפָּטָיו לְיִשְׂרָאֵל. לֹא עָשָׂה כֵן לְכָל גּוֹי וּמִשְׁפָּטִים בַּל יְדָעוּם הַלְלוּ- יָהּ"
The midrash concludes this section with an extension of the proof text for the above gematria. The extension with the appended verse used to clarify the supposition, leads the reader to see the unique status of the Jewish people is that they were chosen to receive the Torah and that makes them special.

Nitzavim

My Musing
Dedicated this week to the refuah shleima of Dov’s a”h grandmother.
I must first apologize for only posting the first part of the midrash tanhuma this week. It has been rather busy. But it is this first part that spoke to me this week.

This week I gave my talk about polytheism to our 6th graders. I wanted to help them appreciate how radical the idea of monotheism as practiced by Judaism really was when it came onto the world scene. Many people casually use the term monotheistic to describe Judaism but I think it misses the point. The monotheism of Judaism is so radical because it dictates that not only is there only one God in this world, this one God controls everything. The Talmud (B. Berachot 60a) posits that we bless God for the good and the bad. As I explained to the 6th graders we make a blessing when one dies with God’s name. That is the unique contribution of Judaism to the world; One God in control of everything. As Job later accepted, when bad things happen it is unfathomable but it is all by the hand of God. As the Talmud teaches in Makot, a tzadik lives by his faith.

As we approach Rosh Hashanah I believe that we need to be cognizant of this contribution Judaism gave to the world and to us. We need to understand that our existence is contingent on God and His playing by the rules. Not some cosmic random event.

This week’s selection deals with the concept of why the Jews are still here when other nations have sinned and have disappeared. The term used in the midrash is “tekuma”, revival or re-establishment. How many times have the Jewish people been on the verge of annihilation and yet experience a tekumah? This is a divine promise.

מדרש תנחומא (ורשא) פרשת נצבים סימן א

The midrash comments on the opening phrase of the parsha, Moshe addressing the Israelites saying that they are all standing. The midrash cites the verse from Proverbs that declares the evil doers to be upturned and the righteous to remain standing.


(דברים פרק כט:ט) "אַתֶּם נִצָּבִים הַיּוֹם כֻּלְּכֶם לִפְנֵי יְדֹוָד אֱלֹקֵיכֶם, רָאשֵׁיכֶם שִׁבְטֵיכֶם, זִקְנֵיכֶם וְשֹׁטְרֵיכֶם, כֹּל אִישׁ יִשְׂרָאֵל "
"אַתֶּם נִצָּבִים הַיּוֹם", זה שאמר הכתוב (משלי יב:ז) "הָפוֹךְ רְשָׁעִים וְאֵינָם וּבֵית צַדִּיקִים יַעֲמֹד"
The midrash continues with an analysis that the Holy One Blessed be He looks at the actions of the evil doers and they have no hope to be revived. The midrash recalls the destruction of the generation of the flood and tower, the annihilation of Sdom the destruction of Egypt as they pursued the Israelites one last time, and th downfall of the Babylonian empire.

כל זמן שהקדוש ברוך הוא מסתכל במעשיהם של רשעים ומהפך בהם אין להם תקומה:
הפך במעשיהם של דור המבול; לא היתה להם תקומה. שנאמר(בראשית ז:כג) "וַיִּמַח אֶת כָּל הַיְקוּם אֲשֶׁר עַל פְּנֵי הָאֲדָמָה מֵאָדָם עַד בְּהֵמָה עַד רֶמֶשׂ וְעַד עוֹף הַשָּׁמַיִם וַיִּמָּחוּ מִן הָאָרֶץ וַיִּשָּׁאֶר אַךְ נֹחַ וַאֲשֶׁר אִתּוֹ בַּתֵּבָה:
הפך במעשיהם של אנשי סדום ולא היתה בהן תקומה. שנאמר (בראשית יט:כה) " וַיַּהֲפֹךְ אֶת הֶעָרִים הָאֵל וְאֵת כָּל הַכִּכָּר וְאֵת כָּל יֹשְׁבֵי הֶעָרִים וְצֶמַח הָאֲדָמָה"

ועל כולם אמר דוד (תהלים לו:יג) " שָׁם נָפְלוּ פֹּעֲלֵי אָוֶן דֹּחוּ וְלֹא יָכְלוּ קוּם"
אבל ישראל נופלין ועומדין.
וכן הוא אומר (מיכה ז:ח) " אַל תִּשְׂמְחִי אֹיַבְתִּי לִי כִּי נָפַלְתִּי קָמְתִּי כִּי אֵשֵׁב בַּחֹשֶׁךְ יְדֹוָד אוֹר לִי" (מלאכי ג:ו) " כִּי אֲנִי יְדֹוָד לֹא שָׁנִיתִי וְאַתֶּם בְּנֵי יַעֲקֹב לֹא כְלִיתֶם"

The midrash concludes this list of eveil doers who have been vanquished by God and will not return with a promise to the Jews that they will not be destroyed. The midrash then continues with the statement of Rabbi Chanina who explains that as many as half the Israelite nation may fall but the nation as a whole will never cease to exist.


אמר רבי חנינא בר פפא אמר הקדוש ברוך הוא: מעולם לא הכיתי אומה ושניתי לה אבל אתם בני יעקב לא כליתם שנאמר (דברים לב:כג)" אַסְפֶּה עָלֵימוֹ רָעוֹת חִצַּי אֲכַלֶּה בָּם"חצי כלין והן אינן כלים. וכך אמרה כנסת ישראל (איכה ג:יב) "דָּרַךְ קַשְׁתּוֹ וַיַּצִּיבֵנִי כַּמַּטָּרָא לַחֵץ"
משל למה הדבר דומה?
לגבור שהעמיד את הקורה והיה זורק בו את החצים, חציו כלין והקורה במקומה עומדת. אף ישראל כל זמן שהיסורים באין עליהן היסורין כלין והם במקומן עומדין ואינן כלין. לכך נאמר (משלי יב: ז)
"הָפוֹךְ רְשָׁעִים וְאֵינָם וּבֵית צַדִּיקִים יַעֲמֹד"
אמר חזקיה בנו של רבי חייא למה נסמכה פרשה זו לפרשת קללות?
This section of “consolation”, according to Hizkiah, is placed at this juncture to soothe the worries of the Israelites as they heard the curses for malfeasance to the commandments in the Land of Israel.

לפי ששמעו ישראל מאה קללות חסר אחת או שתים, שנאמר, בפרשה זו חוץ מארבעים ותשע שנאמרו בתורת כהנים, מיד הוריקו פניהם ואמרו 'מי יכול לעמוד באלו?' מיד קרא אותן משה והיה מפייסן.
מה כתיב למעלה מן הענין
(דברים כט:א-ב) "וַיִּקְרָא מֹשֶׁה אֶל כָּל יִשְׂרָאֵל וַיֹּאמֶר אֲלֵהֶם אַתֶּם רְאִיתֶם אֵת כָּל אֲשֶׁר עָשָׂה יְדֹוָד לְעֵינֵיכֶם בְּאֶרֶץ מִצְרַיִם לְפַרְעֹה וּלְכָל עֲבָדָיו וּלְכָל אַרְצוֹ. הַמַּסּוֹת הַגְּדֹלֹת אֲשֶׁר רָאוּ עֵינֶיךָ הָאֹתֹת וְהַמֹּפְתִים הַגְּדֹלִים הָהֵם.
(דברים כט:ו) " וַתָּבֹאוּ אֶל הַמָּקוֹם הַזֶּה וַיֵּצֵא סִיחֹן מֶלֶךְ חֶשְׁבּוֹן וְעוֹג מֶלֶךְ הַבָּשָׁן לִקְרָאתֵנוּ לַמִּלְחָמָה וַנַּכֵּם"

לפיכך אמר להם הקב"ה אף על פי שקללות הללו באות עליכם הן מעמידות אתכם, וכן הוא אומר (דברים ח:טז) " הַמַּאֲכִלְךָ מָן בַּמִּדְבָּר אֲשֶׁר לֹא יָדְעוּן אֲבֹתֶיךָ לְמַעַן עַנֹּתְךָ וּלְמַעַן נַסֹּתֶךָ לְהֵיטִבְךָ בְּאַחֲרִיתֶךָ", וכך אמר להם משה לישראל אף על פי שהיסורין הללו באין עליכם יש לכם עמידה לכך נאמר "אַתֶּם נִצָּבִים הַיּוֹם כֻּלְּכֶם"

Here the midrash infers an even more radical idea that our survival is in fact helped by these travails and struggles. So much so that when you experience trouble it is the first step in the fulfillment of the promise that the Jews will never be forsaken.

This week’s tanhuma will be also dedicated to the refuah shleima of Dov’s grandmother, my mom, פייגע רייכל בת רודל
Why do we pray three times a day? The classic answer is from the Talmud in berachot. Either tefilah- the standing devotion- amidah- shemoneh esrei- was instituted in response to the loss of the daily and festival sacrifices or it was designed to follow the lead of the patriarchs. Heres another radical idea and it is tied to the bikurim confessional. Just as there are three levels of devotional in the true worship of the Almighty, there are three opportunities to connect with The Holy One Blessed be He.

מדרש תנחומא (ורשא) פרשת כי תבא סימן א
(דברים פרק כו:טז) "הַיּוֹם הַזֶּה יְדֹוָד אֱלֹקֶיךָ מְצַוְּךָ לַעֲשׂוֹת אֶת הַחֻקִּים הָאֵלֶּה וְאֶת הַמִּשְׁפָּטִים וְשָׁמַרְתָּ וְעָשִׂיתָ אוֹתָם בְּכָל לְבָבְךָ וּבְכָל נַפְשֶׁךָ"


This week’s midrash begins with a quote from the parsha which declares that day at the end of Moshe’s life was a day that God commanded the Israelites to follow laws and statutes. The previous section is the confessional recited for the first fruits offering, the bikurim. The verse introduced to produce comment on the citation from the parsha indicates three levels of worship- bowing, prostration, and blessing.


"הַיּוֹם הַזֶּה יְדֹוָד אֱלֹקֶיךָ מְצַוְּךָ לַעֲשׂוֹת"
זה שאמר הכתוב (תהלים צה:ו) "בֹּאוּ נִשְׁתַּחֲוֶה וְנִכְרָעָה נִבְרְכָה לִפְנֵי יְדֹוָד עֹשֵׂנוּ"
והלא כריעה בכלל השתחויה, והשתחויה בכלל כריעה?
ומה תלמוד לומר "נִשְׁתַּחֲוֶה וְנִכְרָעָה נִבְרְכָה"?

In exegetical manner the midrash points out two anomalies with the words: The act of prostration includes bowing and bowing includes prostration. And what is the connection with blessing?


אלא צפה משה ברוח הקודש וראה שבית המקדש עתיד ליחרב והבכורים עתידין ליפסק.
עמד והתקין לישראל שיהיו מתפללין שלשה פעמים בכל יום, לפי שחביב תפלה לפני הקב"ה מכל מעשים טובים ומכל הקרבנות. שכך כתיב (תהלים קמא:ב) "תִּכּוֹן תְּפִלָּתִי קְטֹרֶת לְפָנֶיךָ מַשְׂאַת כַּפַּי מִנְחַת עָרֶב"

The midrash explains that when Moshe foresaw the destruction of the Temple and the bikurim offering would cease to be offered, he established that the Bnai Israel will pray three times a day, since prayer- the standing devotion (Amidah) is more dear to the Lord than all good deeds and sacrifices.


ומשה רבינו אף על פי שעשה כל מעשים טובים, כיון שנגזר עליו שלא ליכנס לארץ התפלל ואמר (דברים ג:כה) "אֶעְבְּרָה נָּא וְאֶרְאֶה אֶת הָאָרֶץ הַטּוֹבָה אֲשֶׁר בְּעֵבֶר הַיַּרְדֵּן הָהָר הַטּוֹב הַזֶּה וְהַלְּבָנֹן"


The midrash, though, also implies that prayer has a limit. Although Moshe was entirely good deeds, he was powerless to ameliorate the decree that he would not enter Israel. The midrash builds on the timing of the denial of Moshe’s plea to demonstrate that this was the day that Moshe gave his charge to the Israelites.


ואמר לו הקדוש ברוך הוא (דברים ג:כו-כז) "וַיִּתְעַבֵּר יְדֹוָד בִּי לְמַעַנְכֶם וְלֹא שָׁמַע אֵלָי, וַיֹּאמֶר יְדֹוָד אֵלַי, 'רַב לָךְ, אַל תּוֹסֶף דַּבֵּר אֵלַי עוֹד בַּדָּבָר הַזֶּה. עֲלֵה רֹאשׁ הַפִּסְגָּה וְשָׂא עֵינֶיךָ יָמָּה וְצָפֹנָה וְתֵימָנָה וּמִזְרָחָה וּרְאֵה בְעֵינֶיךָ כִּי לֹא תַעֲבֹר אֶת הַיַּרְדֵּן הַזֶּה'"
לכך נאמר "הַיּוֹם הַזֶּה יְדֹוָד אֱלֹקֶיךָ מְצַוְּךָ לַעֲשׂוֹת". מה כתיב למעלה מן הענין (דברים כו:טו)
"הַשְׁקִיפָה מִמְּעוֹן קָדְשְׁךָ מִן הַשָּׁמַיִם וּבָרֵךְ אֶת עַמְּךָ אֶת יִשְׂרָאֵל וְאֵת הָאֲדָמָה אֲשֶׁר נָתַתָּה לָנוּ כַּאֲשֶׁר נִשְׁבַּעְתָּ לַאֲבֹתֵינוּ אֶרֶץ זָבַת חָלָב וּדְבָש"ׁ


The midrash now departs on a tangent from the previous discussion but addresses a unique quality of the bikurim ritual. The midrash draws an analogy from the normal mode of approaching a king with a request that might or might not be granted to the bikurim ceremony.

אמר רבי אבהו בשם רבי יוסי בר חנינא: בא וראה כמה מתחטאין וכמה יש להן פתחון פה לעושי מצות. אדם יש לו עסק אצל מלכות, פעמים שהוא נותן כמה ממון עד שמגיעין אותו אצל המלך. כיון שהגיע אצל המלך ספק עושה שאלתו ספק לא עשה, אבל הקדוש ברוך הוא אינו כן. אלא יורד אדם לתוך שדהו ראה אשכול שביכר, תאנה שביכרה,רמון שביכר, מניחו בסל והולך לירושלים. ובא ועומד באמצע העזרה ומבקש רחמים על עצמו ועל ישראל ועל ארץ ישראל. שנאמר "הַשְׁקִיפָה מִמְּעוֹן קָדְשְׁךָ מִן הַשָּׁמַיִם וּבָרֵךְ אֶת עַמְּךָ אֶת יִשְׂרָאֵל וְאֵת הָאֲדָמָה וגו'". ולא עוד, אלא שהיה אומר איני זז מכאן עד שתעשה צרכי היום הזה שכתוב אחריו "הַיּוֹם הַזֶּה יְדֹוָד אֱלֹקֶיךָ מְצַוְּךָ לַעֲשׂוֹת".


The unique quality of the bikurim ritual is a reflection of the unique quality of the Israelites. Not only does the farmer bare his soul and ask for his own benefit but also for his nation and the land.

אמר רבי שמעון בן לקיש: יצתה בת קול ואמרה לו 'תזכה לשנה הבאה ותביא כהיום הזה כאדם שהוא נותן פרי חדש לחברו, ואומר לו, יהי רצון שתשנה ותתן לי לשנה האחרת.
אמר רבי חייא בר אבא: 'כמה מתחטאין עושי מצות לפני הקדוש ברוך הוא שהקדוש ברוך הוא גוזר גזירה וצדיקים מבטלין אותה שנאמר (קהלת ח:ד-ה) " בַּאֲשֶׁר דְּבַר מֶלֶךְ שִׁלְטוֹן וּמִי יֹאמַר לוֹ מַה תַּעֲשֶׂה. שׁוֹמֵר מִצְוָה לֹא יֵדַע דָּבָר רָע וְעֵת וּמִשְׁפָּט יֵדַע לֵב חָכָם"
מי הוא? "שׁוֹמֵר מִצְוָה לֹא יֵדַע דָּבָר רָע" ממחה על ידו של הקדוש ברוך הוא. וכן בדוד הוא אומר (שמואל ב, כג:ג)" אָמַר אֱלקֵי יִשְׂרָאֵל לִי דִבֶּר צוּר יִשְׂרָאֵל מוֹשֵׁל בָּאָדָם צַדִּיק מוֹשֵׁל יִרְאַת אֱלקִים"


Now the mishna returns to its original question about the uniqueness of this day-


מהו "הַיּוֹם הַזֶּה יְדֹוָד אֱלֹקֶיךָ"?
וכי עד עכשיו לא צוה הקדוש ברוך הוא את ישראל?! והלא אותה שנה שנת ארבעים היתה, שנאמר(דברים א:ג) " וַיְהִי בְּאַרְבָּעִים שָׁנָה בְּעַשְׁתֵּי עָשָׂר חֹדֶשׁ בְּאֶחָד לַחֹדֶשׁ דִּבֶּר מֹשֶׁה אֶל בְּנֵי יִשְׂרָאֵל כְּכֹל אֲשֶׁר צִוָּה יְדֹוָד אֹתוֹ אֲלֵהֶם"


Is this really about choosing one day at the end of his career?


ומה תלמוד לומר "הַיּוֹם הַזֶּה"?
אלא כך אמר משה לישראל: בכל יום יהא התורה חביבה עליכם כאלו היום הזה קבלתם אותה מהר סיני. וכן הוא אומר במקום אחר(דברים ד: ט-י) "רַק הִשָּׁמֶר לְךָ וּשְׁמֹר נַפְשְׁךָ מְאֹד פֶּן תִּשְׁכַּח אֶת הַדְּבָרִים אֲשֶׁר רָאוּ עֵינֶיךָ וּפֶן יָסוּרוּ מִלְּבָבְךָ כֹּל יְמֵי חַיֶּיךָ וְהוֹדַעְתָּם לְבָנֶיךָ וְלִבְנֵי בָנֶיך. יוֹם אֲשֶׁר עָמַדְתָּ לִפְנֵי יְדֹוָד אֱלֹקֶיךָ בְּחֹרֵב, בֶּאֱמֹר יְדֹוָד אֵלַי הַקְהֶל לִי אֶת הָעָם וְאַשְׁמִעֵם אֶת דְּבָרָי אֲשֶׁר יִלְמְדוּן לְיִרְאָה אֹתִי כָּל הַיָּמִים אֲשֶׁר הֵם חַיִּים עַל הָאֲדָמָה וְאֶת בְּנֵיהֶם יְלַמֵּדוּן" "וְהוֹדַעְתָּם לְבָנֶיךָ וְלִבְנֵי בָנֶיך" כתיב בתריה " יוֹם אֲשֶׁר עָמַדְתָּ לִפְנֵי יְדֹוָד "


The Torah should be as dear, fresh and unique to you as when you got it. And the mishna makes two suggestions for the making the Torah fresh. Act like the Torah is your passion and it will be as if you received the Torah. How does one accomplish this?


"אֶת הַחֻקִּים" - אלו המדרשות, "וְאֶת הַמִּשְׁפָּטִים" - אלו הדינין.
דבר אחר, "אֶת הַחֻקִּים וְאֶת הַמִּשְׁפָּטִים" לרבות קלים וחמורים, גזירות שוות ודקדוקי סופרים. "וְשָׁמַרְתָּ וְעָשִׂיתָ אוֹתָם"
אמר רבי יוחנן כל העושה מצוה לאמתו מעלה עליו הכתוב כאילו היא נתונה מהר סיני שנאמר, "וְשָׁמַרְתָּ וְעָשִׂיתָ אוֹתָם". ומה תלמוד לומר "ועשיתם אותם" אלא כל המקיים את התורה ועשה אותה לאמתו כאילו הוא תקנה ונתנה מהר סיני.


Rabbi Yochanan is quoted to offer an answer. By fulfilling the commandments one demonstrates their devotion to the Torah and I remains fresh. And now the midrash will return to the idea of three times daily prayer that seems to have been instituted in recognition of what was destined to happen.


ועוד אמר רבי יוחנן כל העושה תורה לאמתה מעלה עליו הכתוב כאלו הוא עשה את עצמו. שנאמר, (דברים ד:יד) "וְאֹתִי צִוָּה יְדֹוָד בָּעֵת הַהִוא לְלַמֵּד אֶתְכֶם חֻקִּים וּמִשְׁפָּטִים לַעֲשֹׂתְכֶם אֹתָם בָּאָרֶץ אֲשֶׁר אַתֶּם עֹבְרִים שָׁמָּה לְרִשְׁתָּה"
'לעשות אותם' לא נאמר, אלא 'לעשותכם אותם' מכאן שמעלין עליו כאלו הוא עשה וברא את עצמו.בכל לבבך הרי הכתוב מזהיר את ישראל ואומר להם בשעה שאתם מתפללים לפני הקב"ה לא יהיה לכם שתי לבבות אחד לפני הקב"ה ואחד לדבר אחר.


The midrash finishes with an admonition in the guise of a prescription for success. Don’t have two hearts when you pray- in other words stay focused.

Ki Teizei

What does it mean to remember? This week is the 7th anniversary of 9/11. What must we remember and for waht purpose?

The end of this week’s parsha is the commandment to remember the Amalekites and what they did. It is also the commandment to wipeout the memory of them. How are we to remember and obliterate the memory at the same time?

Alas this selection of the midrash does not address this quandary but it does raise an interesting thought about the benefit of memories. There are memories which are good and those which are bad for us.

Memories are how we connect to our past and prepare for the future. If we remember those of our family who are role models then we are able to be like them but if we choose to memorialize the evil in the world then we do not succeed.

But memories can have another detrimental effect. You can recall the memories and cause great distress. That is the message of the second half of our selection.

Be careful when you remind someone of their past and heritage. It can build them up or take them down.

מדרש תנחומא (ורשא) פרשת כי תצא סימן ה
(דברים כה:יז) "זָכוֹר אֵת אֲשֶׁר עָשָׂה לְךָ עֲמָלֵק בַּדֶּרֶךְ בְּצֵאתְכֶם מִמִּצְרָיִם"

The midrash opens with the statement of Rabbi Tanhuma that God wants us to be diligent with the two imperatives to remember in this week’s Torah reading. The midrash continues to explain that how we remember is the key.


רבי תנחומא בר חנילאי פתח (איוב יג:יב) "זִכְרֹנֵיכֶם מִשְׁלֵי אֵפֶר לְגַבֵּי חֹמֶר גַּבֵּיכֶם"
אמר הקדוש ברוך הוא לישראל, אותן שתי זכירות שכתבתי לכם בתורה הוו זהירין בהן. "תִּמְחֶה אֶת זֵכֶר עֲמָלֵק", "זָכוֹר אֵת אֲשֶׁר עָשָׂה לְךָ עֲמָלֵק" משלי אפר, משולי אפר. אם זכיתם, אתם בניו של אברהם שהמשיל עצמו כאפר. שנאמר, ( בראשית יח:כז) "וַיַּעַן אַבְרָהָם וַיֹּאמַר הִנֵּה נָא הוֹאַלְתִּי לְדַבֵּר אֶל אֲדֹ-נָי וְאָנֹכִי עָפָר וָאֵפֶר. ואם לאו "לְגַבֵּי חֹמֶר גַּבֵּיכֶם" התקינו עצמכם לשעבודה של מצרים שנאמר, (שמות א:יד) " וַיְמָרְרוּ אֶת חַיֵּיהֶם בַּעֲבֹדָה קָשָׁה בְּחֹמֶר וּבִלְבֵנִים וּבְכָל עֲבֹדָה בַּשָּׂדֶה אֵת כָּל עֲבֹדָתָם אֲשֶׁר עָבְדוּ בָהֶם בְּפָרֶךְ" [ס"א לשעבוד גליות [מלכויות] שנאמר, (תהלים קכט:ג) " עַל גַּבִּי חָרְשׁוּ חֹרְשִׁים הֶאֱרִיכוּ <למענותם> לְמַעֲנִיתָם"]

How you use the memories is the key. Proper use of the memories can raise you to heights of Abraham, misuse of the memories can bring you to the sullen state of the Egyptian servitude.

דבר אחר: "זִכְרֹנֵיכֶם מִשְׁלֵי אֵפֶר" איוב אמר פסוק זה כנגד חביריו. בשעה שידעו אותן היסורין היו אומרים כנגדו דברים קשים. אמר להם איוב"זִכְרֹנֵיכֶם מִשְׁלֵי אֵפֶר " מה אתם מתעים את הבריות שרואין אתכם וסוברים בכם שאתם צדיקים כאברהם שנאמר בו "וְאָנֹכִי עָפָר וָאֵפֶר" ואתם לגבי חומר גביכם כדור הפלגה שכתוב בהן ( בראשית יא:ג) "וַיֹּאמְרוּ אִישׁ אֶל רֵעֵהוּ הָבָה נִלְבְּנָה לְבֵנִים וְנִשְׂרְפָה לִשְׂרֵפָה וַתְּהִי לָהֶם הַלְּבֵנָה לְאָבֶן וְהַחֵמָר הָיָה לָהֶם לַחֹמֶר”

Continuing with this idea of proper use of memories, the midrash relates the phrase to the tragedy of Job. When Job is “comforted” by his friends, they point out that he must have brought this on himself. The midrash puts the admonition into Job’s mouth and he equates these friends with the generation of the Tower of Babel, instead of what we assume the friends feel is their equation with Abraham.

What makes the Jews better?
The initial reaction might be Torah or ethics/morals. This week’s midrash takes the lead on this question and answers that it is our more exacting legal system.
What does it mean that God chose to give the Torah and His laws to the Israelites? Are we inherently more law abiding?
The midrash seems to counter that the Gentiles are law abiding and have a Divine imperative to create a just legal system. What sets us apart is that we are more exacting. As an example offered by the midrash- justice can be administered in a Gentile court by one judge on the evidence offered by one witness. The Beit Din system requires three judges for civil disputes and 23 judges for death penalty. The two witnesses are subjected to a heightened scrutiny. I guess being more demanding can be good.

מדרש תנחומא (ורשא) פרשת שופטים סימן א
(דברים טז:יח) "שֹׁפְטִים וְשֹׁטְרִים תִּתֶּן לְךָ בְּכָל שְׁעָרֶיךָ אֲשֶׁר יְדֹוָד אֱלֹקֶיךָ נֹתֵן לְךָ לִשְׁבָטֶיךָ וְשָׁפְטוּ אֶת הָעָם מִשְׁפַּט צֶדֶק"
We are commanded to establish courts of law and methods of enforcement in all our neighborhoods. The midrash will focus on the “to you”.

"שֹׁפְטִים וְשֹׁטְרִים" זה שאמר הכתוב (תהלים קמז:יט) "מַגִּיד <דברו> דְּבָרָיו לְיַעֲקֹב חֻקָּיו וּמִשְׁפָּטָיו לְיִשְׂרָאֵל"
"דְּבָרָיו", אלו דברי תורה, " חֻקָּיו", אלו המדרשות, " וּמִשְׁפָּטָיו" אלו הדינין. לא נתן הקדוש ברוך הוא את התורה ואת המשפטים אלא לישראל בלבד.

The midrash relates a verse from Psalms to our parsha which describes the Torah and the laws as being the unique domain of the Israelites.

ומנין אתה למד?
שישראל ועובד כוכבים ומזלות שיש להם עסק זה עם זה, שאסור לישראל לומר לעכו"ם לך עמי לערכאות שלכם. ושהוא עובר בלאו, שנאמר,(תהלים קמז:כ)"לֹא עָשָׂה כֵן לְכָל גּוֹי, וּמִשְׁפָּטִים בַּל יְדָעוּם הַלְלוּ יָהּ"

The midrash continues with a halacha that if an Israelite is engaged in a legal dispute with a
Gentile then every effort must be made to use the adjudication of an Israelite court. The reason is given as another verse from Psalms that states that the Gentiles do not know the laws. Of course that statement is problematic- the Gentiles are enjoined to have courts of law as one of the seven Noahide commandments.



והלא אומות העולם נצטוו על הדינין שהיא אחת משבע מצות שנצטוו בני נח?!
ומהו " וּמִשְׁפָּטִים בַּל יְדָעוּם"? אלו דקדוקי הדין.
שכך שנינו: מעשה ובדק בן זכאי בעוקצי תאנים. ובני נח הורגים בעד אחד, ובדיין אחד, ושלא בהתראה. משאין כן בישראל, לפי שדיני ממונות בשלשה ודיני נפשות בעשרים ושלשה. וכתיב (דברים יט:טו)" לֹא יָקוּם עֵד אֶחָד בְּאִישׁ לְכָל עָוֹן וּלְכָל חַטָּאת בְּכָל חֵטְא אֲשֶׁר יֶחֱטָא עַל פִּי שְׁנֵי עֵדִים אוֹ עַל פִּי שְׁלֹשָׁה עֵדִים יָקוּם דָּבָר" וצריכין דרישה וחקירה.

The answer given by the midrash is that the systems of law differ by the intricacies. The Gentile courts are presided over by one judge and accept the testimony of a single witness. The Israelite courts require three judges for torts and 23 judges for death penalty cases. And the Israelite courts require prior warning before the defendant can be accused and that the witnesses be investigated.


כיצד בודקין את העדים?
מכניסין אותן ומאיימין עליהם, ועוד היו בודקין בשבע חקירות: באיזה יום?, באיזה שבוע, באיזה חדש, בכמה לחדש, באיזה שעה, באיזה מקום? מכירין אתם אותו? התריתם בו? כדאמרינן במסכת סנהדרין.

How are the witnesses checked? The pair are separated warned (threatened) and questioned in seven arenas.
The Midrash proceeds to enukerate glorious times in our ancient history where the Israelites were praised in scrioture and among the nations for their legal system. Among the leaders who established the law are the prophet Samuel, King David, and King Jehosaphat, and Moses on the advice of Jethro. Even Jerusalem was recognized for its high level of Justice.


וכן את מוצא בפרנסי ישראל שלא נשתבחו אלא על ידי הדין. בשמואל כתיב (שמואל א , ז:טז)"וְהָלַךְ מִדֵּי שָׁנָה בְּשָׁנָה וְסָבַב בֵּית אֵל וְהַגִּלְגָּל וְהַמִּצְפָּה וְשָׁפַט אֶת יִשְׂרָאֵל אֵת כָּל הַמְּקוֹמוֹת הָאֵלֶּה"
ואף דוד לא נשתבח אלא על ידי הדין כמה דכתיב (דברי הימים א, יח:יד)" וַיִּמְלֹךְ דָּוִיד עַל כָּל יִשְׂרָאֵל וַיְהִי עֹשֶׂה מִשְׁפָּט וּצְדָקָה לְכָל עַמּוֹ"
ואף יהושפט, כיון שנתחזק במלכות לא נתעסק בעסקי מלכות, ולא בעושר, ולא בכבוד, ולא בדבר אחר, אלא בדין, שנאמר, (דברי הימים ב, יז: א)"וַיִּמְלֹךְ יְהוֹשָׁפָט בְּנוֹ תַּחְתָּיו וַיִּתְחַזֵּק עַל יִשְׂרָאֵל"
מהו " וַיִּתְחַזֵּק "?
שנתחזק ומינה את הדיינין ואומר (דברי הימים ב, יז:ו) "וַיִּגְבַּהּ לִבּוֹ בְּדַרְכֵי יְדֹוָד וְעוֹד הֵסִיר אֶת הַבָּמוֹת וְאֶת הָאֲשֵׁרִים מִיהוּדָה"
גסות רוח היתה בו! שהוא אומר "וַיִּגְבַּהּ לִבּוֹ", אלא שמינה דיינין עליהן היודעין ללכת בדרכי ה' שנאמר (בראשית יח:יט)" כִּי יְדַעְתִּיו לְמַעַן אֲשֶׁר יְצַוֶּה אֶת בָּנָיו וְאֶת בֵּיתוֹ אַחֲרָיו וְשָׁמְרוּ דֶּרֶךְ יְדֹוָד לַעֲשׂוֹת צְדָקָה וּמִשְׁפָּט לְמַעַן הָבִיא יְדֹוָד עַל אַבְרָהָם אֵת אֲשֶׁר דִּבֶּר עָלָיו"
ואומר לדיינין ראו (דברים א:יז) "לֹא תַכִּירוּ פָנִים בַּמִּשְׁפָּט כַּקָּטֹן כַּגָּדֹל תִּשְׁמָעוּן לֹא תָגוּרוּ מִפְּנֵי אִישׁ כִּי הַמִּשְׁפָּט לֵאלֹקִים הוּא וְהַדָּבָר אֲשֶׁר יִקְשֶׁה מִכֶּם תַּקְרִבוּן אֵלַי וּשְׁמַעְתִּיו"
ומה משה שלא נצטווה על הדיינין אלא ממה שאמר לו יתרו שנאמר, (שמות יח:כא)" וְאַתָּה תֶחֱזֶה מִכָּל הָעָם אַנְשֵׁי חַיִל יִרְאֵי אֱלֹקִים אַנְשֵׁי אֱמֶת שֹׂנְאֵי בָצַע וְשַׂמְתָּ עֲלֵהֶם שָׂרֵי אֲלָפִים שָׂרֵי מֵאוֹת שָׂרֵי חֲמִשִּׁים וְשָׂרֵי עֲשָׂרֹת", הושיב סנהדרין, אנו שנצטוינו בתורה למנות סנהדרין שנאמר "שֹׁפְטִים וְשֹׁטְרִים תִּתֶּן לְךָ" על אחת כמה וכמה!
ומנין שהושיב משה סנהדרין על ישראל?
דכתיב (שמות יח:כה)" וַיִּבְחַר מֹשֶׁה אַנְשֵׁי חַיִל מִכָּל יִשְׂרָאֵל וַיִּתֵּן אֹתָם רָאשִׁים עַל הָעָם שָׂרֵי אֲלָפִים שָׂרֵי מֵאוֹת שָׂרֵי חֲמִשִּׁים וְשָׂרֵי עֲשָׂרֹת"
ואף ירושלים לא נשתבחה אלא על ידי הדין שנאמר (יחזקאל טז:יד)" וַיֵּצֵא לָךְ שֵׁם בַּגּוֹיִם בְּיָפְיֵךְ כִּי כָּלִיל הוּא בַּהֲדָרִי אֲשֶׁר שַׂמְתִּי עָלַיִךְ נְאֻם אֲדֹנָי יְדֹוִד"

But Jerusalem was destroyed when its system of justice was perverted. And God will extract in kind payment for those that pervert justice.


ואיזה הוא הדור זה הדין שנאמר (שמות כג:ג)" וְדָל לֹא תֶהְדַּר בְּרִיבוֹ", ולא חרבה ירושלים אלא על קלקול הדין שנאמר (יחזקאל כב:ה)" הַקְּרֹבוֹת וְהָרְחֹקוֹת מִמֵּךְ יִתְקַלְּסוּ בָךְ טְמֵאַת הַשֵּׁם רַבַּת הַמְּהוּמָה" שם שהיה לך על ידי הדין טמאת. וכתיב (ישעיהו א:כא) "אֵיכָה הָיְתָה לְזוֹנָה קִרְיָה נֶאֱמָנָה מְלֵאֲתִי מִשְׁפָּט צֶדֶק יָלִין בָּהּ וְעַתָּה מְרַצְּחִים על ידי שהיתה "מְלֵאֲתִי מִשְׁפָּט צֶדֶק יָלִין בָּהּ". לכך אמר להם ירמיה (איכה ד:יב)" לֹא הֶאֱמִינוּ מַלְכֵי אֶרֶץ <וכל> כֹּל יֹשְׁבֵי תֵבֵל כִּי יָבֹא צַר וְאוֹיֵב בְּשַׁעֲרֵי יְרוּשָׁלִָם" וכתיב (איכה ד:יג)" מֵחַטֹּאת נְבִיאֶיהָ עֲוֹנוֹת כֹּהֲנֶיהָ הַשֹּׁפְכִים בְּקִרְבָּהּ דַּם צַדִּיקִים". באותה שעה נשבע הקדוש ברוך הוא שהוא נפרע לעצמו מן הדיינין שנאמר (ישעיהו א: כד) "לכן נאם האדון ה' צבאות אביר ישראל וגו', ואין לכן אלא לשון שבועה שנאמר (שמואל א , ג:יד)" וְלָכֵן נִשְׁבַּעְתִּי לְבֵית עֵלִי אִם יִתְכַּפֵּר עֲוֹן בֵּית עֵלִי בְּזֶבַח וּבְמִנְחָה עַד עוֹלָם"
אין אביר אלא אב ב"ד שנאמר (שמואל א, כא: ח) "ָׁם אִישׁ מֵעַבְדֵי שָׁאוּל בַּיּוֹם הַהוּא נֶעְצָר לִפְנֵי יְדֹוָד וּשְׁמוֹ דֹּאֵג הָאֲדֹמִי אַבִּיר הָרֹעִים אֲשֶׁר לְשָׁאוּל" , ללמדך שהקב"ה נעשה אב ב"ד להפרע מהן
מניין שבדיינין הכתוב מדבר? ראה מה כתיב אחריו (ישעיהו א: כו ) "ָשִׁיבָה שֹׁפְטַיִךְ כְּבָרִאשֹׁנָה וְיֹעֲצַיִךְ כְּבַתְּחִלָּה אַחֲרֵי כֵן יִקָּרֵא לָךְ עִיר הַצֶּדֶק קִרְיָה נֶאֱמָנָה" לפיכך אמר דוד "מַגִּיד <דברו> דְּבָרָיו לְיַעֲקֹב חֻקָּיו וּמִשְׁפָּטָיו לְיִשְׂרָאֵל"
